This Policy of the Delek Motors Group, which includes the Delek Motors Ltd. Company, companies from the EuroDrive Group and other Group Companies, current and future (including subsidiaries and/or affiliates) (hereinafter, severally:  “We”, “the Group” or “Delek Motors”), applies to personal information (information concerning an identified or identifiable individual) about you, which is gathered, stored and/or used with relation to all of the services, products and activities of Delek Motors, including the Internet websites, the landing pages, the applications and other digital assets which are the property of, and/or which  are operated by the Group and/or anyone acting on its behalf (“the Website”), and also, when contacting and communicating with the Group through the various channels, such as the telephone, mail and email, SMSs, social media, face-to-face conversations, such as when you arrive at one of our service workshops and/or dealerships and/or any other means of Delek Motors (hereinafter, severally: “the Services”).

This Policy is an integral part of the terms applicable to the website and of the additional terms (as per their definition there) (hereinafter, severally: “the Binding Documents”). Thus for example, directives regarding Delek Motors’ limited liability, the applicable law and the jurisdiction location, will apply to this Privacy Policy. Terms which are not defined in this Privacy Policy will bear the meaning assigned to them in the Terms of Use.

  1. Your agreement with the terms of use and Privacy Policy

Data you share and/or which will be gathered concerning you as part of your use of the services offered by Delek Motors, will be stored in our databases and will be processed by us and may be shared among the Group’s companies for the sake of providing the Services, according to the provisions of the law.  For your information, as a rule you are under no legal obligation to provide Delek Motors any personal information whatsoever or to enable gathering of the information unless specifically stated otherwise, however please be advised that failure to provide the information might prevent you from using the website or prevent Delek Motors from providing you part of the services it offers.  Use of the Website and/or the provision of personal information concerning you, is an indication of your consent to this Privacy Policy, as well as to the binding documents. If you do not agree with one of the terms detailed hereinafter, and/or specified in the binding documents, please refrain of continuing to use the website and/or the other services and/or contact us to enable us to assist you by alternative means.

  1. What information do we gather?

      2.1. Personal Information provided by you

While using the Website and the services offered therein, you might be asked to provide personal information in accordance with the nature of the services being sought. This information may include, inter alia, full name, contact details, email address, details concerning the services being sought an any other additional personal information you will provide us through the use of the Website, the Services or through any other contact you make with the Group. For further details regarding specific cases, see below and/or read the information that will appear when you are requested to disclose personal information.

Please make sure you provide correct, complete details. Insofar as there will be changes to the personal information you have provided, and which impact our ability to respond to your contact and/or the services being sought, you are requested to update us.

Insofar as you are providing personal information for and/or in the name of a third party, you hereby declare that you are authorized and have the legal authorization to disclose the personal information regarding another person and that the disclosure of the said information has been done after having obtained that person’s consent to the disclosure of the information to the Group in accordance with this Privacy Policy, and that this fact does not infringe on the rights of the third party and/or on that individual’s privacy.

    2.2. Customer Service and Contacting the Group

At the time of contacting our Customer Service, you will be requested to provide, inter alia, the license plate number of the vehicle concerning which you are contacting us and the reason for making contact. This is done so as to enable us to locate the details of the vehicle, the warranty terms, the service history and other information about the vehicle, which are required for evaluating your contact.

The information you provide when contacting the Group, including over the WhatsApp platform (“WhatsApp”), and/or through a chat on the Website and/or through other channels, including the telephone number, the content of the contact and the correspondence, and files you may upload, as stored in the Delek Motors systems.

The use of WhatsApp and/or other channels is subject to the Privacy Policy and to the terms of use of those providers, as these may be updated from time to time. We make it clear that We bear no responsibility for the processing of that information by WhatsApp and/or other providers. For more information on the privacy practices of those providers, please refer to their Privacy Policy documents and/or their terms of use.

Furthermore, conversations held with Delek Motors may be recorded for the sake of control and service improvement.

    2.3. Purchases and Payments

When you purchase and/or lease a vehicle from us, We shall ask you to provide us additional information, which will include, inter alia, the order and purchase details, contact details, licenses, ID documents (for example, your ID card and driving license), and additional documents necessary for concluding the deal and/or regarding the services being sought and any other information that will be requested at the time the purchase and/or payment is being made, and which is marked as a mandatory field, and any other information you will provide concerning the purchase and/or the lease. In certain cases (for example, in order to license a tax-exempt vehicle), We may also request information concerning your medical condition, including disability and other exemptions.

When making the payment through a credit card, the payment will be transacted through a secured clearing page, in which you will be requested to fill in the details of the means of payment you will be using to make the payment. Delek Motors does not save the details of the means of payment (with the exception of the last four digits of the credit card number) in its databases. The clearing services are provided by third parties, and they keep this information securely and in accordance with their privacy policy. Information about the services you have purchased and/or the payment you have made, will be stored in the Delek Motors systems.

    2.4. Submitting a Curriculum Vitae and Recruitment Processes

Insofar as you are interested in vacancies at Delek Motors, you are welcome to submit your candidacy through our Careers page on our Website, at the following address: https://www.delek-motors.co.il When submitting your candidacy, you will be requested to provide the following information, among other things: Full name, mailing address, email address, phone number, professional experience, education, details included in your curriculum vitae or other documents you have attached as part of your contact with the Group, such as information related to your education and professional background, employment experience, references and any other personal information that is submitted within the context of submitting a candidacy.

Furthermore, we may contact previous employers and references you have specified when submitting your candidacy with the Group. This will be done in order to obtain further information concerning evaluation of your candidacy.

    2.5. Information received from third parties

In certain cases, we might obtain information concerning you from other sources. This privacy policy applies to such information as well, even if it is not obtained directly from you. Such cases may include:

  • While providing the services, car manufacturers enable us to access details concerning you and the vehicle you have purchased. This is done in order to enable us to provide the services. Such details can include, for example, contact details, operational information about the vehicle and the environment, car maintenance data, car condition etc.
  • Authorized workshops provide us personal information about you and about the vehicle they are maintaining. For example full name, phone, email, details about the vehicle, the maintenance performed on it etc.

 

    2.6. Automatically-Gathered Personal Information

It is possible that, as part of your contact with Delek Motors or while using the services, Delek Motors and/or anyone acting on its behalf may, automatically and/or depending on the context, gather additional information, which includes the date and time of the contact and its duration, method of contacting us – meaning through which channel you made contact.

Furthermore, we might use certain monitoring technologies, such as cookies files. pixels, tags and scripts (hereinafter, severally: “Cookies”), which are integrated within the digital assets. These technologies gather and analyze data regarding the method the digital assets are being used. They are gathered for the purposes detailed below. Part of the Cookies are operated by us (“First-Party Cookies”) and some are operated by external partners that provide us data analysis services, advertising and marketing services (“Third-Party Cookies”), who may also use the data gathered for their own business needs.

  • Essential Cookies. Are used for the ongoing operation and proper functioning of the digital assets and for securing them. These cookies do not gather information through which you, or information that may be associated with you, might be identified (targeted).
  • Performance and Statistics Cookies. Are used to measure the method of use of the digital assets in order to analyze, assess and improve the performance of the Digital Assets. These enable the website to understand how persons visiting the various pages browse among them, how long they remain in the website, what contents are more popular than others, and also to obtain insights that enable us to maintain, measure and improve our marketing, advertising and sales work. To this end We implement Third-Party Cookies from providers such as Google Analytics and Clarity.
  • Functional Cookies. Are used to record the settings and selections the user has made, in order to optimize the user experience. These concession enable, among other things, saving of the interface language, layout settings, log-in details and operation of essential functions within the website.
  • Marketing and Advertising Cookies. Are used to display advertisements and content relevant to your interests, including in third-party websites and services, based on your Internet usage history and browsing history. To this end We implement Third-Party Cookies from providers such as social media platforms, Google Ads and Clarity.

  1. How is the Gathered Information Used?

Delek Motors will make use of the personal information you have provided and/or which has been gathered by it and/or by third parties for the purposes specified in this Privacy Policy and for any other purpose specified in the relevant documents, including:

  1. Maintaining the Delek Motors business and service delivery, including purchase/leasing of vehicles, obtaining service at the Service Centers, vehicle servicing, insurance, claims, customer service, sending of service messages from the office etc.;
  2. As part of manpower recruitment;
  3. Provision of content from Delek Motors and/or third parties, including the way the advertising contents are presented as per their definition in the Communications Law (Telecommunications and Broadcasting), 5741-1982, Direct Mailing and/or direct mailing services, as per their definition in the Protection of Privacy Law, 5741-1981 (“Direct Mailing”, “Direct Mailing Services” and “Protection of Privacy Law”), as detailed below;
  4. Modification and improvement of the Website and/or the Services and adjusting them to your preferences and optimization of the user experience, identification of return users, as reflected from analysis of the statistical data gathered by the Group and/or third parties, including those concerning your website and/or service usage habits;
  5. The proper administration of the website and operation of the services offered therein, including for information security purposes and for enforcement of the terms of use of the Website and/or for enforcing the directives of the binding documents.
  6. As required by law and/or for enforcement purposes and/or to protect the rights, property and/or legal interests and/or other interests of the Group and/or of third parties;
  7. In defense against lawsuits, claims and/or other legal proceedings;
  8. For in-house documentation purposes;
  9. Any other purpose, as detailed when requesting personal information, in this Privacy Policy, or in any of the binding documents.

Additionally, Delek Motors is permitted to use statistical or aggregated information, not of a personal nature, and which does not identify you for any purpose, including to improve, enhance or streamline the services, for research and statistical purposes and also for training and model development purposes.

  1. Where will the information be stored?

The information gathered, or which you will provide while using the website and the services offered by Delek Motors will be kept in the Delek Motors databases.

It is possible that personal information will be stored and/or processed in Israel or outside Israel, in places where privacy protection laws are less stringent than those in Israel. In such case, Delek Motors will do its best to take precautions ensuring a similar level of protection for personal information, and will proceed in accordance with the directives in the Privacy Protection (Transfer of Data to Databases Abroad) Regulations, 5761-2001.

  1. Is the information forwarded to third parties?

In addition to the abovementioned, Delek Motors will forward the information about you to third parties, insofar as this is necessary within the context of the binding documents, this Privacy Policy, due to a legal obligation, and in the following cases:

Insofar as necessary for the proper delivery of the services – for example, if the provision of the personal information is done to proxies of Delek Motors and/or to anyone operating on its behalf, including consultants, suppliers and service providers of Delek Motors, for the purpose of delivering the services and/or for running the website and/or for running the Delek Motors marketing work;
  2. For information transfer to Delek Motors-authorized workshops, this being done, inter alia, for the sake of maintaining continuity of the vehicle servicing, documentation of the service history, and for providing optimal service in accordance with the manufacturer’s instructions.
  3. If Delek Motors has requested your permission, and you have granted your explicit consent;
  4. If you purchase products and services from third parties through the website, these third parties will be sent the information they need to complete the process and deliver the service;
  5. In case of a legal dispute and/or allegation and/or claim between you and Delek Motors, or of you perform actions in the website in violation of a law or if you violate this Privacy Policy or the binding documents;
  6. Following a court ruling or according to demand from a legally competent authority;
  7. To prevent severe harm to you and/or your property or to the body or property of a third party or of Delek Motors;
  8. When using the services, links to external pages, websites, platforms or apps might appear (“External pages”), for example in the form of advertisements, banners, links, etc. These links are provided for your convenience only and Delek Motors bears no responsibility for the availability of these external pages or to their information gathering policies. Delek Motors has no connection to third-party privacy policies and it is your responsibility to find out about them before using these websites.

Information gathering by vehicle manufacturers while the vehicle is in use. In some of the vehicles sold or serviced by Delek Motors, personal information might also be gathered by car manufacturers through various means, including through the vehicle systems and through other digital services. Information gathering and processing by the car manufacturers are subject to the terms of use and to the privacy policy of the respective car manufacturers, which we will bring to your attention while the relevant service provision agreement is being made. You are required to read them and proceed in accordance with them.

It is emphasized that the contents are not published by Delek Motors or on its behalf and Delek Motors has no control over them and does not supervise them. The inclusion of a link to a specific website and/or forwarding to such a website, does not imply Delek Motors’ agreement with their content and does not provide any indication that the contents of the linked website and/or body and/or organization and/or operator are reliable, and that the information they provide is complete or up-to-date. The use of these contents and/or services is solely your responsibility.

Delek Motors is at liberty to remove previously-included links from the website, or to refrain from adding new links – all at its sole and exclusive discretion. Delek Motors is not responsible for, nor will it be liable for any loss, whether indirect or direct, which may be incurred by you or your property as a result of the use of, or reliance on, an advertisement, activity, information or contents included in the websites you will be reaching or which are posted by bodies you will be reaching through or by using a link, a reference or advertisement of any sort that is included in the website.

  1. Registration to receive marketing content and direct mailing

Insofar as you have signed up to receive a newsletter, direct mail and/or messages from the Group (“Marketing Messages”), We will send you marketing, advertising and informational content from time to time, concerning the products and services of Delek Motors. The said contents may be sent through any means of communication, including mail, email, phone or mobile phone, SMS, Push, WhatsApp, social media and other means (including through the use of third parties and external websites).

By providing your email and/or phone number in the course of your signing up to receive the said marketing messages, you are granting your consent to receive advertising content according to Clause 30A of the Communications Law (Telecommunications and Broadcasting), 5742-1982. You can opt out of this agreement to receive these messages at any time, by clicking the “Unsubscribe” link in one of the email communications you receive from the Group or through any other means as will be specified in the marketing message, according to any law. It is made clear that doing so will not rule out the sending of service messages by the Group.

As a rule, the Services are intended for users 18 years of age or older. Insofar as certain services are also intended for users aged 18 or less, these users will require obtaining the consent of their parents or legal guardian, before using the said services and providing personal details on the website.

You have the right to ask to see the information gathered about you and to correct it. This refers to information stored in the Delek Motors databases, in accordance with the directives in clauses 13 and 14 of the Protection of Privacy Law, all in accordance with legally-prescribed exceptions. Delek Motors takes measures it regards as adequate, and uses advanced technological and organizational security means to secure the data it controls, against incidental or deliberate loss, destruction or access by unauthorized or unqualified persons. This being said, Delek Motors cannot guarantee absolute information security and retention and it makes no commitment that its services will be absolutely impervious to unauthorized access to the information stored on its systems. By using the website and its services, you acknowledge that you are aware and agree to these limitations.

We store the personal information We require for providing the Services, and for supporting our ongoing business activities, in accordance with the Group’s procedures and as required by law. In addition, We might continue to retain your personal information if necessary. For example, for potential preparations for a legal proceeding or for documentation and archiving purposes and for other legal needs. Your personal information will be kept on the Delek Motors database, which may also be kept and managed for Delek Motors by a third party.

Delek Motors reserves the right to alter its Privacy Policy from time to time. In such a case, the notice of the change will be posted in the website and will be updated in this document.
